Judge Reverses Verdict In KCI Wound Therapy IP Suit

Law360, New York (October 21, 2010, 11:57 AM EDT) -- A federal judge has handed Smith & Nephew Inc. a resounding win against rival medical technology company Kinetic Concepts Inc., overturning a jury verdict and invalidating two patents Kinetic asserted against Smith & Nephew’s negative pressure wound therapy devices.

On Monday, Judge W. Royal Ferguson of the U.S. District Court for the Western District of Texas broke from the jury’s March finding and ruled that claims in KCI’s patents are invalid as obvious in light of prior art.
