Plaintiff Rejects New Verdict In Merck Fosamax Case

Law360, New York (October 25, 2010, 6:48 PM EDT) -- A Florida woman is seeking a new trial on damages now that a federal judge has sliced $6.5 million from an $8 million jury verdict she won in a lawsuit against Merck & Co. Inc. over the osteoporosis drug Fosamax.

Plaintiff Shirley Boles told the U.S. District Court for the Southern District of New York in a letter Friday that she is declining the verdict, which Judge John F. Keenan cut to $1.5 million earlier this month.
