Fed. Circ. Nixes Rhodia Bid To Arbitrate Secrets Feud

Law360, New York (October 26, 2010, 5:03 PM EDT) -- A federal appeals court has upheld a lower court's dismissal of Rhodia SA's bid to send to arbitration a suit brought by Invista SARL over trade secrets related to nylon manufacturing, ruling that an earlier decision by an international arbitration panel mooted the challenge.

The U.S. Court of Appeals for the Third Circuit on Monday concluded that because the Arbitration Tribunal of the International Chamber of Commerce ruled that it had no jurisdiction over Rhodia, the company could not pursue its claims in federal court either....
