Law360, New York (October 28, 2010, 5:15 PM ET) -- A lawyer for plaintiffs in the multidistrict litigation accusing Del Monte Fresh Produce Co. of monopolizing the extra-sweet pineapple market told an appeals court Thursday that a lower court wrongly threw out their expert testimony and dismissed their suit.
The competing pineapple sellers' attorney Douglas Richards of Cohen Milstein Sellers & Toll PLLC argued for the revival of a case before the U.S. Court of Appeals for the Second Circuit, saying that expert Ronald Cotterill raised a valid theory about the market for pineapples.
