9th Circ. Pushes Mediation In Rio Human Rights Suit

Law360, New York (October 28, 2010, 4:55 PM EDT) -- The U.S. Court of Appeals for the Ninth Circuit has ordered a lower court to decide whether a massive human rights class action against mining giant Rio Tinto PLC stemming from a civil war in Papua New Guinea should go to mediation.

In a decision that sparked a fierce dissent from Circuit Judge Andrew J. Kleinfeld, the Ninth Circuit gave the district court 28 days to decide whether mediation should proceed or if the case should heard by the appeals court en banc.
