Law360, New York (November 01, 2010, 2:55 PM ET) -- Fresenius Medical Care Holdings Inc. has lodged a patent infringement suit in an effort to prevent Indian pharmaceutical company Lupin Ltd. from marketing a generic version of PhosLo GelCaps.
The suit, filed Friday in the U.S. District Court for the District of Massachusetts, takes aim at both Lupin and a U.S. subsidiary, Lupin Pharmaceuticals Inc. following their submission of an abbreviated new drug application with the U.S. Food and Drug Administration.
