Macy's ERISA Action Gets The Boot

Law360, New York (November 8, 2010, 12:54 PM EST) -- A federal judge has dismissed a putative class action alleging Macy's Inc. failed to properly notify employees of retailers it acquired that they were eligible for the Macy's retirement plan.

Judge Ronald M. Whyte of the U.S. District Court for the Northern District of California on Friday ruled that the claims in the Employee Retirement Income Security Act suit, brought former employees of Carter Hawley Hale Stores Inc. and Broadway Stores Inc. against Macy's, did not result in poor performance at the retailer's retirement plan....
