Wyeth Effexor Patent Valid, Infringed: Australian Judge

Law360, New York (November 09, 2010, 2:54 PM ET) -- An Australian judge has determined that generic-drug maker Sigma Pharmaceuticals (Australia) Pty Ltd.'s attempt to distribute a copycat version of antidepressant Effexor infringes Wyeth Inc.'s valid patent for the drug.

Justice Jayne Jagot of the Federal Court of Australia on Monday ruled that Sigma had infringed nine claims of Australian Patent Number 2003259586 by importing, taking orders for, selling, supplying and offering to supply products under the brand name Evelexa XR in Australia.
