2 Suits Call Defense Of Marriage Act Unconstitutional

Law360, New York (November 9, 2010, 7:14 PM EST) -- Federal lawsuits lodged Tuesday by the American Civil Liberties Union and others ask district courts to declare the 1996 Defense of Marriage Act unconstitutional.

Edith Schlain Windsor, represented by attorneys from Paul Weiss Rifkind Wharton & Garrison LLP, the ACLU and the New York Civil Liberties Union, lodged her suit in the U.S. District Court for the Southern District of New York, targeting the federal government's estate tax on same-sex married couples.
