Energizer Faces False Marking Suit Over Batteries

Law360, New York (November 15, 2010, 11:55 AM EST) -- Energizer Holdings Inc. has been hit with a qui tam suit alleging it deceived the public and deterred would-be competitors by knowingly marking its e2 lithium batteries with four expired patents.

Sher Corwin LLC's David S. Corwin lodged the suit for plaintiff Morris Turek in the U.S. District Court for the Southern District of Illinois on Nov. 9, alleging that the battery maker has injured the United States and the public by discouraging innovation in competing products.
