Verizon Workers Lose OT Arbitration Bid

Law360, New York (November 11, 2010, 2:28 PM EST) -- A federal judge has refused to allow a number of Verizon Communications Inc. call center employees to arbitrate wage-and-hour claims against their staffing agency after they lost a bid for class certification last year.

On Tuesday, Judge Steven D. Merryday of the U.S. District Court for the Middle District of Florida dismissed the suit against PDS Technical Services Inc., finding that the plaintiffs have pursued the underlying suit too intently for too long to now invoke the arbitration clause of their employment contract.
