Enviros Appeal NC Tree-Burning Order For Duke

Law360, New York (November 12, 2010, 2:09 PM EST) -- Two environmental groups are asking a North Carolina appeals court to reverse a decision by the state's utilities commission to allow Duke Energy Carolinas LLC to earn renewable energy credits for burning whole trees in its power plants.

The Southern Environmental Law Center and the Environmental Defense Fund filed a notice of appeal with the North Carolina Utilities Commission on Wednesday. The groups argue the state's renewable energy law only allows wood waste, not whole trees, to qualify as renewable energy sources.
