Cancer Patients Lose Discovery Battle With Insurer

Law360, New York (November 17, 2010, 4:15 PM EST) -- A federal judge in Oklahoma has rejected a bid by a putative class of cancer patients who accuse American Fidelity Assurance Co. of short-changing them through its reimbursement regime to prevent the insurer from seeking protection from discovery orders in other courts.

Judge Vicki Miles-LaGrange of the U.S. District Court for the Western District of Oklahoma denied the plaintiffs' motion requesting that she enjoin AFA from seeking protective orders from other courts related to discovery in their suit.
