Metal Co.'s Subpoena Against DOD Overbroad: Judge

Law360, New York (November 18, 2010, 2:52 PM EST) -- A judge has ruled that the U.S. Department of Defense need not comply with a subpoena obtained by Western Titanium Inc., a California-based metal supplier currently on trial for military contracting fraud, calling the company’s request for documents overbroad.

Judge Janis Sammartino of the U.S. District Court for the Southern District of California on Wednesday quashed Western Titanium’s subpoena against the DOD on the ground that the company sought to use the subpoena as a discovery tool.
