Law360, New York (November 22, 2010, 5:23 PM EST) -- Demonstrating an increased willingness to aggressively respond to consumer concerns in the area of food and beverage products, the U.S. Food and Drug Administration has effectively banned the sale of caffeinated alcoholic beverages. In warning letters issued to four beverage manufacturers recently, the FDA advised that the "additive" of caffeine rendered the beverages "adulterated" and therefore unsafe.
