Dollar General Triumphs In Manager's FLSA Suit

Law360, New York (November 19, 2010, 12:00 AM EST) -- A federal judge has thrown out a wage-and-hour suit alleging Dollar General misclassifies its store managers as exempt from overtime pay, telling plaintiffs in some 20 related lawsuits to decide whether it’s worth continuing to litigate their claims.

On Thursday, Judge Aleta A. Trauger of the U.S. District Court for the Middle District of Tennessee granted summary judgment to Dolgencorp Inc., finding that the plaintiff’s job duties were chiefly managerial and merited her exemption from the overtime provisions of the Fair Labor Standards Act.
