3rd Circ. Revives Suit Against UPMC, Highmark

Law360, New York (November 30, 2010, 7:11 PM EST) -- A federal appeals court has breathed new life into a lawsuit in which West Penn Allegheny Health System Inc. accused the University of Pittsburgh Medical Center and health insurer Highmark Inc. of violating the Sherman Act by forming a conspiracy to protect one another from competition.

A three-judge panel of the U.S. Court of Appeals for the Third Circuit handed down a 44-page precedential opinion on Monday reversing a district court decision to throw out West Penn's Sherman Act claims.
