Ex-Wal-Mart Exec Must Wait To Join CVS, Judge Says

Law360, New York (December 3, 2010, 7:40 PM EST) -- Wal-Mart Stores Inc. has won a temporary restraining order barring former executive Harry Mullany III from joining CVS Caremark Corp. to lead its retail division, in a lawsuit alleging the move violates a noncompete agreement and poses trade secrets concerns.

Vice Chancellor J. Travis Laster issued the order Friday in the Delaware Court of Chancery temporarily barring Mullany from being employed by CVS. A hearing on a preliminary injunction has been scheduled for Dec. 15.
