Supreme Court Takes Up Climate Change Nuisance Suit

Law360, New York (December 6, 2010, 1:15 PM EST) -- The U.S. Supreme Court on Monday agreed to hear a case that will determine whether states, conservation groups and private citizens have standing to bring climate change public nuisance lawsuits against large emitters of greenhouse gases.

Several power companies, including American Electric Power Co. Inc., had asked the Supreme Court to wade into this arena after the U.S. Court of Appeals for the Second Circuit ruled against them in September 2009 and then denied their petition for a rehearing en banc.
