Greenberg Bid For Docs In IP Malpractice Suit Nixed

Law360, New York (December 7, 2010, 6:21 PM EST) -- A federal judge has shot down Greenberg Traurig LLP's latest move to defend against Leviton Manufacturing Co.'s $100 million patent malpractice suit, denying the firm access to a load of patent prosecution documents the company prepared with counsel it hired to replace the firm.

Magistrate Judge Theodore H. Katz of the U.S. District Court for the Southern District of New York on Monday denied Greenberg's motion to compel the documents, finding that Leviton had not waived its attorney-client privilege.
