Fluctuating Workweek OT Case Lands In High Court

Law360, New York (December 8, 2010, 4:59 PM EST) -- A former clerical employee at a real estate appraisal firm has asked the U.S. Supreme Court to review an appellate decision that applied "fluctuating workweek" regulations and reduced her damages for unpaid overtime, saying it throws overtime standards for salaried employees into disarray.

Brenda Urnikis-Negro filed the cert petition on Dec. 2, several months after the U.S. Court of Appeals for the Seventh Circuit ruled that her overtime award should be reduced under the “fluctuating workweek” standards set forth by the U.S. Department of Labor....
