Appeals Board Keeps Lockheed Contract Suit Alive

Law360, New York (December 9, 2010, 6:30 PM EST) -- The U.S. Civilian Board of Contract Appeals has refused to dismiss claims from a Lockheed Martin Corp. unit that wants an increase in the price of a medical staff services contract.

A three-judge panel of the appeals board on Wednesday agreed with Lockheed Martin AspenMed Services Inc. that, as a participant in a contractor team arrangement, it had standing as a prime contractor to submit a certified claim to the contracting officer and to file a subsequent appeal before the board.
