9th Circ. Denies Fees In Pipeline Land Taking Case

Law360, New York (December 10, 2010, 5:28 PM ET) -- A federal appeals court has ruled that a landowner can't use a federal law on government property acquisitions to recoup costs incurred while fighting a condemnation action brought and then abandoned by a private agency operating under federally granted powers that sought to build a gas pipeline.

In an opinion issued Wednesday, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit upheld the denial of such costs to Agua Fria Investments LLC, which was the target of condemnation proceedings Transwestern Pipeline Co....
