Vitamin Maker To Pay FDA $2M Over Health Claims

Law360, New York (December 14, 2010, 2:16 PM EST) -- The Federal Trade Commission has reached a $2.1 million settlement with vitamin producer and marketer NBTY Inc. over what the agency said were false and unproven health claims related to the company's Disney and Marvel Heroes-themed children's vitamins.

Unveiling the settlement Monday, the FTC claimed NBTY and two of its subsidiaries, NatureSmart LLC and Rexall Sundown Inc., made deceptive claims about the amount of DHA — an omega-3 fatty acid — that was included in their Disney and Marvel Heroes-licensed multivitamin gummies and tablets for kids....
