Liberty Mutual Off Hook In Hearing-Loss Defense

Law360, New York (December 15, 2010, 4:48 PM EST) -- Following the example of an appeals court, a federal judge has thrown out Continental Holdings Inc.’s suit claiming Liberty Mutual Insurance Co. and American Motorists Insurance Co. are obligated to cover the paper manufacturer in litigation alleging industrial noise caused hearing loss among scores of workers.

On Tuesday, Judge Robert James of the U.S. District Court for the Western District of Louisiana found that the insurers' workers' compensation and employer’s liability policies exclude coverage for hearing-loss claims.
