Fen-Phen Atty Deserved Policy Rescission: Insurer

Law360, New York (December 16, 2010, 7:19 PM ET) -- Continental Casualty Co. has urged a federal appeals court to reject disbarred lawyer Melbourne Mills Jr.'s appeal of an order rescinding his policy after he covered up a criminal probe into his actions concerning a $200 million settlement in a class action over diet drug fen-phen.

The district court was so clear in ruling that Mills' omissions precluded him from coverage that the matter need not be argued orally, Continental said in a brief submitted Wednesday in the U.S. Court of Appeals for the Sixth Circuit....
