Law360, New York (December 23, 2010, 7:40 PM ET) -- A federal appeals court on Thursday ruled that an $18 million fine against natural gas provider Southern Union Co. for illegally storing mercury at a Rhode Island facility wasn't excessive.
A three-judge panel of the U.S. Court of Appeals for the First Circuit denied the company's appeal, saying that the fine was justified because of the company's willingness to put the waste in a densely populated residential community and the government's desire for "a penalty substantial enough to attract the attention of large corporations."
