Target, Walgreen Dodge China Duty On Pencil Imports

Law360, New York (December 23, 2010, 7:04 PM EST) -- Target Corp. and Walgreen Co. have temporarily wriggled free of China-wide duties on imported cased pencils, winning preliminary injunctions Thursday against liquidation of the products.

Judge Jane Restani of the U.S. Court of International Trade ruled in a pair of orders that U.S. Customs and Border Protection should not liquidate the retail giants’ entries of the pencils before determining whether the agency misapplied the China-wide rate of 114.9 percent.
