7th Circ. Keeps Text Message Antitrust Suit Alive

Law360, New York (January 3, 2011, 2:38 PM EST) -- A federal appeals court has rejected a bid by Verizon Wireless LLC, AT&T Mobility LLC, Sprint Nextel Corp. and T-Mobile USA Inc. to throw out a putative class action alleging the companies conspired to fix text message prices.

The U.S. Court of Appeals for the Seventh Circuit issued the ruling Dec. 29, agreeing with a lower court that the case should proceed because the plaintiffs' second amended complaint met heightened federal pleading standards laid out recently by the U.S. Supreme Court in Bell Atlantic Corp. v....
