Imation, Others Didn't Infringe Toshiba DVD IP: Judge

Law360, New York (January 3, 2011, 6:59 PM EST) -- A federal judge has dealt a near-fatal blow to Toshiba Corp.'s infringement suit against Imation Corp. and several other recordable DVD makers, ruling that the defendants did not infringe three patents for DVD technology.

In a Dec. 28 ruling, Magistrate Judge Stephen L. Crocker of the U.S. District Court for the Western District of Wisconsin granted a motion for summary judgment of noninfringement, finding that his earlier claims construction decisions meant that the defendants could not be found to have infringed Toshiba's patents-in-suit.
