9th Circ. Asks Calif. Court About Prop 8 Standing

Law360, New York (January 4, 2011, 5:19 PM EST) -- The Ninth Circuit on Tuesday asked California's high court to weigh in on whether supporters of Proposition 8, the state's controversial ban on gay marriage, have standing to fight a lawsuit challenging the law's constitutionality.

The U.S. Court of Appeals for the Ninth Circuit requested that the state supreme court consider whether the official proponents of a ballot initiative have standing to defend the constitutionality of the initiative upon its adoption or to appeal a judgment invalidating the initiative should public officials refuse to defend it....
