Fed. Circ. Hears Claims In Fiber-Optic Patent Spat

Law360, New York (January 10, 2011, 3:25 PM EST) -- Emcore Corp. and Optium Corp. sparred before the Federal Circuit on Monday over whether a jury should have awarded lost profits damages to Emcore and its co-defendant over two patents covering fiber-optic technology.

The U.S. Court of Appeals for the Federal Circuit heard Optium argue that lost profits damages should not have been handed down because there was no evidence Emcore's fellow defendant and appellee JDS Uniphase Corp. had the capacity to produce the modulators that made it possible to build the transmitter devices at issue...
