US Backs Drugmakers In Supreme Court Pricing Suit

Law360, New York (January 10, 2011, 2:49 PM EST) -- The federal government has sided with drug manufacturers in a U.S. Supreme Court case over alleged violations of Medicaid contracts designed to deliver discounted drugs to low-income patients and other vulnerable groups.

In an amicus brief filed with the court Friday, the U.S. said the plaintiffs in the suit, a putative class including California’s Santa Clara County and its federally funded clinics, did not have standing to sue drug companies over alleged breaches of the pharmaceutical pricing agreements in question.
