Law360 (January 14, 2011, 1:38 PM EST) -- On Dec. 13, 2010, a Virginia federal district court ruled[1] the individual health care insurance mandate of the Patient Protection and Affordable Care Act (PPACA) is unconstitutional. This case examined whether the Commerce Clause permits federal regulations to require everyone to have health care insurance. There are now three, and soon to be four, federal lower court decisions addressing the constitutionality of the minimum essential coverage provisions of PPACA.
