CWA Claims Survive In SF Bay Pollution Suit

Law360, New York (January 12, 2011, 7:35 PM ET) -- A federal judge has trimmed San Francisco Baykeeper's suit accusing a local sewage management district of polluting the San Francisco Bay, saying certain claims are better suited to state court.

Judge Edward M. Chen of the U.S. District Court for the Northern District of California on Tuesday allowed the claims brought by the pollution watchdog under the Clean Water Act to move forward, but said the other portions of the suit against West Bay Sanitary District “raise novel and complex issues of state law."
