Caterpillar Retiree Health Care Action Gets Go-Ahead

Law360, New York (January 13, 2011, 1:08 PM EST) -- A federal judge has greenlighted a class action accusing Caterpillar Inc. of breaking a promise to provide retirees' spouses with lifetime free health care, saying an appeals court's ruling that a related suit was time-barred doesn't apply to this case.

A group of retirees' spouses who say Caterpillar illegally reneged on a 1998 employment agreement can continue to press its case, Judge Aleta Trauger of the U.S. District Court for the Middle District of Tennessee said in an order issued Wednesday.
