6th Circ. Asked To Resurrect Ink Antitrust Claims

Law360, New York (January 13, 2011, 5:02 PM ET) -- Static Control Components Inc. is urging the Sixth Circuit to rule that a federal judge grossly underestimated potential damages and used a faulty pleading standard to dismiss antitrust counterclaims in Lexmark International Inc.'s printer cartridge patent infringement suit.

Judge Gregory F. Van Tatenhove of the U.S. District Court for the District of Kentucky ignored Static’s $17.5 million damages estimate when setting a $250,000 injunction bond before trial, Static said in a brief lodged Wednesday in the U.S. Court of Appeals for the Sixth Circuit.
