Enviros Challenge Kan. Coal-Fired Power Plant

Law360, New York (January 14, 2011, 7:38 PM EST) -- The Sierra Club petitioned a Kansas appeals court Friday to overturn a politically charged permit allowing Sunflower Electric Power Corp. to build a coal-fired power plant near Holcomb, Kan.

The petition, filed in the Kansas Court of Appeals, alleges the Kansas Department of Health and Environment flouted the Clean Air Act and accepted bogus data when it approved Sunflower’s permit in December for the new 895 megawatt generating unit.
