Insurer Wants Off Hook For Flooring Defect Cases

Law360, New York (January 18, 2011, 8:14 PM ET) -- The Employers Insurance Co. of Wausau filed suit Tuesday against Oscoda Plastics Inc., claiming it does not owe the flooring products company coverage for two underlying product defect lawsuits.

The insurer's suit in the U.S. District Court for the Eastern District of Michigan seeks a judgment that it is not required to defend Oscoda under general liability policies issued to Duro-Last Roofing Inc., also named as a defendant.

Oscoda opened in 1993 to produce accessories for Duro-Last, according to Duro-Last's website.
