10th Circ. Nixes Rail Worker OT Action Against Watco

Law360, New York (January 21, 2011, 6:41 PM ET) -- A statutory exemption for rail workers under federal labor law trumps a proposed class action's argument that holding company Watco Cos. Inc. was two rail workers' joint employer and therefore was liable for overtime claims, the Tenth Circuit ruled Friday.

The precedential decision, in the U.S. Court of Appeals for the Tenth Circuit, affirmed Judge Robin J. Cauthron's February dismissal of a Fair Labor Standards Act proposed class action seeking overtime pay in Oklahoma federal court.
