Judge Keeps Retaliation Claim Alive In Big Dig Suit

Law360, New York (January 21, 2011, 7:50 PM EST) -- A concrete company has lost a bid to dismiss a former employee from a suit alleging the company retaliated against him for a False Claims Act suit over Boston's Big Dig highway project that resulted in a $50 million settlement.

Judge William G. Young of the U.S. District Court for the District of Massachusetts denied Aggregate Industries Inc.'s motion for summary judgment on Wednesday, refusing to dismiss former worker Donald Finney from the case.
