Fed. Circ. Keeps Ban On Illegal Philip Morris Cig Imports

Law360, New York (January 24, 2011, 3:01 PM EST) -- The Federal Circuit on Monday affirmed without comment a U.S. International Trade Commission order banning Philip Morris International Inc. cigarettes sold online by foreign companies from being imported into the U.S.

The U.S. Court of Appeals for the Federal Circuit upheld a 2009 ITC general exclusion order instructing U.S. Customs and Border Protection to deny the entry of Marlboro, Parliament and Virginia Slims cigarettes that infringe Philip Morris trademarks.
