UTi Workers Win Initial Cert. In Overtime Action

Law360, New York (January 26, 2011, 8:14 PM EST) -- A federal judge conditionally certified a nationwide class Wednesday in an overtime suit against UTi Worldwide Inc. and a subsidiary that alleges UTi made forklift operators work off the clock before their paid shifts started. 

Judge J. Phil Gilbert of the U.S. District Court for the Southern District of Illinois signed off on a memorandum and order granting former UTi forklift operator Edward Earl Nicholson's bid for collective action certification.
