ERISA Claims Tossed In Church Publisher Action

Law360, New York (January 27, 2011, 5:43 PM EST) -- A federal judge on Thursday trimmed a proposed breach of contract class action accusing a religious magazine publisher of mismanaging a retirement plan, saying it wasn't subject to the Employee Retirement Income Security Act.

The plan, terminated by Augsburg Fortress Publishers in 2010, falls under an ERISA exemption for pension programs sponsored by church groups, Judge Michael J. Davis ruled in the U.S. District Court for the District of Minnesota.
