Law360, New York (February 01, 2011, 12:32 PM ET) -- In a rare case over a trademark settlement agreement, a New York judge has decided Tequila Cuervo La Rojena SA de CV breached a deal with Jim Beam Brands Co. that restricted Cuervo's use of a crow trademark.
Judge Richard B. Lowe III of the New York Supreme Court for New York County filed the ruling Monday, saying Cuervo is liable for the breach because it used the crow mark — which is similar to Jim Beam's mark — on materials not allowed by the agreement....
