Law360, New York (February 02, 2011, 1:52 PM ET) -- The maker of Nutella has been hit with a putative consumer class action claiming the company deceptively markets the hazelnut spread as nutritious despite high levels of saturated fat and processed sugars.
In a complaint filed Tuesday in the U.S. District Court for the Southern District of California, named plaintiff Athena Hohenberg contends that Ferrero USA Inc. has engineered a misleading advertising campaign touting the nutritional value of Nutella as a breakfast food, complete with images of children enjoying the product before they go to school....
