SC Landowners Want Utility To Pay For Cable Leases

Law360, New York (February 03, 2011, 3:05 PM ET) -- Progress Energy Carolinas Inc. has removed to federal court a putative class action accusing it of improperly leasing electricity easements for telecommunications purposes like high-speed Internet and cable.

The energy company, formerly known as Carolina Power & Light Co., had the suit sent to the U.S. District Court for the District of South Carolina on Wednesday — several weeks after Ernie Dutton, whose aunt owns land on which there are CP&L easements in Darlington County, S.C., filed the complaint in state court in December.
