BMW Unit Loses Bid To Nix S. African Antitrust Suit

Law360, New York (February 4, 2011, 3:59 PM EST) -- South Africa's competition court has refused to dismiss a suit accusing BMW South Africa Ltd. of abusing its dominance by threatening dealers who tried to discount prices for the company's motorcycles, helmets and other accessories.

The South African Competition Tribunal on Tuesday rejected BMW's claims that Fourier Holdings (Pty) Ltd., a BMW-franchised motorcycle dealer, had filed its complaint under the wrong provision of the country's antitrust law and that the complaint was "vague and embarrassing."
