Pa. Court Reinstates $10M Verdict In Prempro Suit

Law360, New York (February 8, 2011, 4:23 PM EST) -- A Pennsylvania appeals court has reinstated $1.7 million in compensatory damages and $8.6 million in punitive damages against Wyeth Pharmaceuticals Inc. in a lawsuit alleging it failed to warn that its hormone-replacement drug Prempro could cause breast cancer.

The Superior Court of Pennsylvania issued the ruling Monday, reversing the trial court's decision to grant Wyeth a new trial and throw out the compensatory damage award. The appeals court also reversed the trial court's decision to throw out the punitive damage award.
