Law360, New York (February 18, 2011, 1:08 PM ET) -- On Jan. 7, 2011, the Massachusetts Supreme Judicial Court ruled against U.S. Bancorp and Wells Fargo & Co. in their appeal of a Massachusetts Land Court decision in March 2009 invalidating their foreclosure sales because both banks had failed to make the requisite showing that they were the mortgage holders at the time of the foreclosures. The case made headlines across the country, but turned on the prosaic notion that only the mortgage holder can foreclose on a mortgage.
